1. Acceptance of Terms
By creating an account on MenuByte or otherwise accessing the service at menubyte.app, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service. These terms form a binding agreement between you and Pamebyte.
2. Description of Service
MenuByte is a software-as-a-service (SaaS) platform providing restaurant management tools to food and beverage businesses in Nigeria. The platform includes:
- Digital menu creation and management
- QR code customer ordering
- Order management and kitchen display system (KDS)
- Bar display system (BDS)
- Staff account management
- Inventory tracking
- Sales reporting and analytics
- Table management
MenuByte is operated by Pamebyte. We reserve the right to modify, add or remove features at any time with reasonable notice to users.
3. Account Registration
- You must provide accurate and complete business information when registering
- You are responsible for maintaining the security of your account credentials
- You must not share your password or allow others to access your account
- Each business should maintain one primary account
- You must be at least 18 years old to register an account
- You are responsible for all activity that occurs under your account
Please notify us immediately at hello@menubyte.app if you suspect any unauthorised access to your account.
4. Subscription and Billing

Free trial
All new accounts receive a 14-day free trial with full access. No credit card is required to start a trial.
Payment
All payments are processed securely by Paystack. Subscriptions renew automatically each month on the same date. You authorise MenuByte to charge your saved payment method for each renewal.
Refund policy
We do not offer refunds once a billing period has started. You may cancel at any time from your account settings — your access will continue until the end of the current billing period, after which your account will move to an inactive state.
Cancellation
You may cancel your subscription at any time with no penalty. Cancellation takes effect at the end of the current paid period.
5. Acceptable Use
You agree to use MenuByte only for lawful purposes in connection with operating a food and beverage business. You agree not to:
- Use MenuByte for any illegal purpose or in violation of Nigerian law
- Attempt to hack, reverse engineer, decompile or disrupt the platform
- Attempt to gain unauthorised access to other accounts or our systems
- Resell, sublicense or white-label the service without written permission from Pamebyte
- Upload, transmit or store content that is harmful, offensive, defamatory or infringes intellectual property rights
- Use automated tools to scrape or extract data from the platform
- Misrepresent your identity or business when registering
Violation of this section may result in immediate account suspension without refund.
6. Intellectual Property
The MenuByte platform, including its code, design, branding, and product features, is owned by Pamebyte and protected by applicable intellectual property law. You may not copy, reproduce or distribute any part of the platform without our prior written consent.
Your data belongs to you. All business data you create within MenuByte — including your menus, orders, staff records, and customer data — remains your property. You grant Pamebyte a limited, non-exclusive licence to store and process this data solely for the purpose of providing the service to you.
You may export your data at any time by contacting hello@menubyte.app.
7. Privacy
Your use of MenuByte is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using MenuByte, you agree to the collection and use of your information as described in that policy.
8. Service Availability
We aim to maintain high availability of the MenuByte platform, but we do not guarantee 100% uptime. The service may be temporarily unavailable due to:
- Scheduled maintenance (communicated in advance where possible)
- Infrastructure incidents at our hosting providers
- Events beyond our reasonable control
We are not liable for losses arising from service interruptions that are outside our reasonable control. For critical service issues, contact hello@menubyte.app.
9. Termination
By you: You may cancel your account at any time from your account settings. Your data will be handled per our Privacy Policy.
By us: We reserve the right to suspend or terminate accounts that violate these Terms of Service, engage in fraudulent activity, or cause harm to the platform or other users. We will provide notice where reasonably practicable except in cases of serious violation.
On termination, your access to the platform will cease and your data will be deleted in accordance with our data retention policy (see Privacy Policy).
10. Limitation of Liability
MenuByte is provided "as is" without warranty of any kind. To the fullest extent permitted by Nigerian law, Pamebyte is not liable for:
- Lost revenue, profits or business opportunities resulting from service interruptions
- Data loss beyond what is reasonably preventable through industry-standard practices
- Actions, errors or omissions of third-party services providers.
- Any indirect, incidental or consequential damages
Our maximum total liability to you for any claim arising from your use of MenuByte is limited to the total amount you paid to MenuByte in the 30 days preceding the claim.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Nigeria. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
12. Changes to Terms
We may update these Terms of Service from time to time. We will notify all registered users of any material changes via email at least 14 days before they take effect. The current version will always be available at menubyte.app/terms. Continued use of the service after changes take effect constitutes your acceptance of the revised terms.
